Terms of service
Plain language, because terms nobody reads protect nobody.
1. What this covers
These terms apply to the IEP VoiceTracker iOS app and this website, both operated by Twologpi. Using either means you accept them. If you are agreeing on behalf of a school or district, you confirm you are able to do so.
2. Your account
You need an account to sync. Keep your credentials to yourself and tell us promptly if you believe someone else has them. You are responsible for what happens under your account.
3. Your data belongs to you
You own what you record. We process it to provide the service and for nothing else. We do not sell it, we do not advertise against it, and we do not use it to train models. You can export it or delete it at any time from within the app.
Student names are held on your device and are not transmitted to us. That is a design constraint, not a setting, which means it also limits what we could disclose if we were ever compelled to.
4. Subscriptions and billing
Paid plans are billed through Apple In-App Purchase. Subscriptions renew automatically until cancelled, and you cancel through Apple rather than through us. Prices are in USD and may change; existing subscribers keep their price when it rises. Refunds are handled by Apple under its own policy.
Downgrading or cancelling never deletes your data. It limits new premium actions.
5. Acceptable use
Do not use the service unlawfully, attempt to break its security, or upload content you have no right to hold. Do not put student names or other identifying details in free-text fields you send to us, such as support messages.
6. Availability
We aim to keep the service running but do not promise uninterrupted availability. Capture works offline by design, so a service interruption should not stop you collecting data.
7. District and school agreements
A personal subscription does not by itself satisfy a district's obligations under FERPA, COPPA or state student-privacy law. District use is governed by a separate signed data processing agreement, which takes precedence over these terms where the two differ. Contact us for that paperwork.
8. Liability
The service is provided as is. To the extent the law allows, our total liability is limited to what you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.
The app helps you record and present data. It does not make educational decisions, and professional judgement about a student remains yours.
9. Changes
We may update these terms. Material changes will be announced in the app or by email before they take effect, and the date above will change.
